SMS / Text Messaging Terms
Wanderworks
When you opt in, you may receive appointment confirmations, quote responses, follow-up questions, service-related updates, and (if you select marketing consent) special offers, discounts, and service announcements from Wanderworks.
You can cancel the SMS service at any time. Just text 'STOP' to +1 (415) 683-3328. After you send the SMS message 'STOP' to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at support@wanderworks.ai.
Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages on an as-needed basis. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
If you have any questions regarding privacy, please read our privacy policy: Privacy Policy
SMS Services on Behalf of Clients
8.1 Service Provider Role
When Wanderworks provides SMS services on behalf of a Client (including but not limited to review request campaigns, appointment reminders, marketing messages, or any other A2P 10DLC messaging), Wanderworks acts as a service provider operating Client's messaging program on Client's behalf. The Client is the sender of record for all such messages.
8.2 Client Representations and Warranties
By providing contact lists, phone numbers, or recipient data to Wanderworks for SMS delivery, Client represents and warrants the following:
- Express Consent: Client has obtained prior express written consent (as defined by the Telephone Consumer Protection Act, 47 U.S.C. § 227, and its implementing regulations at 47 C.F.R. § 64.1200) from each recipient on the provided list to receive the specific type of message that will be sent. For marketing messages, this means consent that is signed, in writing, clearly authorizes marketing communications, and includes the specific business name now sending the message.
- State Law Compliance: Client has obtained consent in compliance with all applicable state laws, including but not limited to the Florida Telephone Solicitation Act (Fla. Stat. § 501.059), the Washington Commercial Electronic Mail Act (RCW 19.190), the Oklahoma Telephone Solicitation Act, and any equivalent state statutes applicable to recipients on the list.
- Consent Documentation: Client maintains documented records of how, when, and from whom consent was obtained, and will provide such records to Wanderworks within five (5) business days of request.
- Opt-Out Management: Client agrees that any STOP, UNSUBSCRIBE, CANCEL, END, or QUIT reply from a recipient must be honored immediately and permanently across all of Client's messaging programs. Client will not re-contact any opted-out recipient.
- List Source: The contact list provided to Wanderworks was collected directly by Client from each recipient. Client has not purchased, rented, scraped, harvested, or otherwise obtained the list from third-party data brokers, list vendors, or any source other than direct customer interaction.
- Content Compliance: Client will not request Wanderworks to send messages that fall under any A2P 10DLC Forbidden Content category, including but not limited to: debt collection without consent, payday lending, gambling, cannabis, hate speech, illegal substances, firearms, or sexually explicit content.
- DBA and Identity Accuracy: All business names, DBAs, and brand identifiers provided to Wanderworks for inclusion in messages are accurate, owned or licensed by Client, and consistent with Client's registered business identity.
8.3 Indemnification
Client agrees to defend, indemnify, and hold harmless Wanderworks, its officers, directors, employees, contractors, and affiliates from and against any and all claims, demands, lawsuits, regulatory actions, penalties, fines, settlements, damages, costs, attorneys' fees, and expenses arising out of or related to:
- Client's breach of any representation or warranty in Section 8.2;
- Any claim that an SMS message sent on Client's behalf violated the TCPA, CAN-SPAM Act, any state consumer protection law, A2P 10DLC carrier policies, or any other applicable law or regulation;
- Any claim by a recipient that they did not consent to receive messages from Client or were re-contacted after opting out;
- Any inaccuracy in business name, DBA, or content provided by Client.
This indemnification obligation survives termination of the service agreement and applies regardless of whether the claim is brought against Wanderworks, its carrier (Twilio, Bandwidth, etc.), or its messaging aggregator.
8.4 Wanderworks Right to Suspend
Wanderworks reserves the right to suspend or terminate SMS services to Client immediately, without notice or refund, if:
- Wanderworks receives a complaint, opt-out volume spike, or carrier notice suggesting messages may have been sent without valid consent;
- Client fails to provide consent documentation within five (5) business days of request;
- The Campaign Registry, Twilio, Bandwidth, or any carrier flags, suspends, or revokes the messaging campaign;
- Wanderworks has a reasonable belief that continued service would expose Wanderworks to legal liability.
8.5 Acceptable Use
Client agrees to comply with Wanderworks's Acceptable Use Policy, incorporated by reference (see wanderworks.ai/acceptable-use). Violation constitutes grounds for immediate termination.
8.6 Survival
Sections 8.2 (Representations), 8.3 (Indemnification), and 8.4 (Right to Suspend) survive termination of this Agreement.
